Advocates In California Urge Protection For Medical Cannabis Patients From Hyper-regulation, Over-taxation, & Corporate Takeover



The Bureau of Cannabis Control is slated to start issuing and processing applications on January 1, 2018.  Further regulations will be presented in November of this year, and the California Department of Consumer Affairs just seated the long-waited Cannabis Advisory Committee mandated by the state’s new cannabis rules.  

What is absent on this committee is any authentic patient voice or social justice advocates.  However, this has been the case in Sacramento during all medical cannabis policy discussions.  Patient advocates have had to demand to be heard or be ignored.  Now that the potential revenue from adult recreational cannabis sales and production is being projected, affordable access to medical cannabis for disabled and low-income patients is the furthest thing on the minds of the new Cannabis Bureaucracy.

Hopefully, the California Cannabis Bureaucracy realizes that we could find ourselves back in a federally hostile environment.  Who did they seat to tackle the possibility that our U.S. Attorney General and Department of Justice may decide to enforce the Controlled Substances Act, again?  Who will deal with the fallout and stand up for the political prisoners?


What is present on this committee is the Drug Policy Alliance.  Members of the Drug Policy Alliance are gaining seats on committees and commissions around the state.  Since DPA’s political action committee donated a significant amount of money to Prop. 64, this would seem to be a conflict.  However, this works out wonderfully for George Soros, who founded and funds DPA, and is heavily vested in Monsanto.   Monsanto stands to win the most from Prop. 64, by acquiring the largest permits and controlling the seeds for recreational, medical and hemp stains.  With Soros’ employees serving around the state the mega-corporate take over of California’s cannabis industry is moving right along.

Despite how the advisory or oversight bodies may be stacked, the regulations themselves equate impractical policy.  Many current businesses will find it burdensome and too expensive to comply.  This creates a monopoly for wealthy, elite players to saturate the marketplace.  True patients and their providers will be priced out and in jeopardy.  Some operations will go deep underground, adding to existing environmental concerns about unregulated cultivation.

How To Contact Your Congressional Representatives - It's Time To End Cannabis Prohibition

Dear Congressmember Adam Schiff,

I write you to about ending cannabis prohibition.  For too long prohibition has denied our business sector the opportunities that come with industrial hemp.  For too long the ‘War On Drugs’ has incarcerated non-violent Americans solely for possession of ‘marihuana.’  For too long America has missed out on the revenue from sales of cannabis products, whether industrial, therapeutic or recreational.  For too long the DEA has interfered with States that already have approved and supported medical cannabis laws on their books.  It’s time for Congress to draft sensible national cannabis policies and stop punishing people over a plant.

I personally have a long history as a cannabis activist and have worked with numerous organizations throughout the country on this issue.  Currently, I am the executive director of Patient Advocacy Network – a charitable 501(c)(3) organization providing education and training to medical cannabis patients and providers, and advocating for patients’ rights and protection.  I have seen first hand the violence and destruction of the DEA’s ‘smash and grab’ tactics here in Los Angeles. 

Please find enclosed a copy of a position paper published by Patient Advocacy Network regarding the issue of ‘rescheduling’ cannabis.  This brief paper explores the Controlled Substances Act highlighting that many of the penalties for cannabis offences under Schedules II – V are more severe than under Schedule I.  However, there are many options for regulating cannabis other than the CSA.

Position Paper by Patient Advocacy Network

There has been much talk from members of Congress and some Governors to "reschedule" marihuana within the Controlled Substances Act.  However, what they don't tell you  is that moving cannabis to a different schedule does not eliminate any federal criminal jeopardy from patients or their collectives.  In some instances the penalties under Schedule III are more harsh than its current Schedule I.

Patients Speak-out Against Further Federal Interference




On July 18, 2011, medical cannabis patient advocates took to the streets of Los Angeles and San Francisco to express concerns about recent statements from Washington DC including the Cole Memorandum. News is that it will be business as usual with respect to federal enforcement of the Controlled Substances Act. Patients are concerned that there will be more hostile smash and grab raids and selective prosecutions.

Patient Advocacy Network has reached out to nearly 90 Congressional offices to discuss medical marijuana, the Controlled Substances Act and continued federal criminal jeopardy for patients. Governors and State AG’s in all medical cannabis states have also been called upon by PAN to help end the federal criminal jeopardy for patients and their cultivators. It is PAN’s contention that cannabis is inappropriately placed in the CSA and needs to regulated more like beer or wine. This is the only legal model that keeps cultivators safe, as safe as those who grow grapes and hops.

While only a handful of patients participated in the LA rally, PAN got the attention of many media outlets: TV, radio, print and internet. “We feel it’s extremely important to be here and express the fear patients and their collectives have over further federal interference BEFORE there are any federal actions this season,” states Degé Coutee to the media during the rally. “The DEA got their funding today on the heels of some very strong statements from Washington. We fear federal raids and prosecutions on non-violent, otherwise law-abiding citizens, some of which are seriously ill or disabled.”
